Definitions

  • “Company” refers to UQuick Technologies India Limited.

  • “Services” means the RestoreX360 website, software, documentation, and all related services.

  • “User” or “You” means anyone accessing or using the Services.

  • “Global Terms” means these Terms & Conditions applicable outside India.

  • “India-Specific Terms” means all policies on www.restorex360.in.

This is not mandatory, but it strengthens the legal clarity. These definitions apply throughout these Terms and all related global policies unless stated otherwise.

 

Global Applicability (Not Valid in India)

These Global Terms & Conditions (“Terms”) apply only to users located outside the Republic of India.
If you are located in India:

  • These Global Terms do not apply

  • They have no legal effect within India

  • You must use the India-specific Terms, EULA, Privacy Policy, and Support Policy available at:

If you misrepresent your location, the Company may restrict service, terminate access, or void any form of support.

 

1. Acceptance of Terms

By accessing, downloading, installing, or using the RestoreX360 website, software, products, or services (“Services”), you confirm that you agree to:

  • These Global Terms & Conditions

  • The Global End-User License Agreement (EULA)

  • The Global Privacy Policy

  • The Global Technical Support Policy

If you do not agree, you must discontinue use of the Services immediately.

 

2. Ownership & Intellectual Property

“RestoreX360,” “RestoreX,” “UQuick,” and related marks are trademarks of UQuick Technologies India Limited.

All software, code, images, text, documentation, and related materials are protected by international copyright and intellectual property laws.

You receive a revocable, non-exclusive, non transferable license under the Global EULA. No ownership rights are transferred.

Unauthorized copying, modification, reverse engineering, resale, or distribution is strictly prohibited.

 

3. License to Use Services

You are permitted to:

  • Access the website and download one copy of the software

  • Use the software for personal or commercial purposes as allowed under the Global EULA

  • Access documentation and available support resources

You are not permitted to:

  • Modify or redistribute the software or website content

  • Reverse engineer, decompile, or tamper with the software

  • Host, mirror, or distribute the software via another server

  • Use the software for unlawful or malicious purposes

Violation results in immediate termination of your license.

 

4. Accuracy & Availability of Information

RestoreX360 does not guarantee that:

  • Website content is accurate, complete, or current

  • Services will be available without interruption

  • Software will operate error-free

  • Features will always meet user expectations

All Services are provided “as is” and “as available.”

 

5. Disclaimer of Warranties

To the fullest extent permitted under international law:

  • The Services are provided without any express or implied warranty, including merchantability, fitness for a particular purpose, or non-infringement.

  • RestoreX360 does not guarantee system compatibility, performance, or uninterrupted functionality.

 

6. Limitation of Liability

RestoreX360 is not liable for:

  • Loss or corruption of data

  • Business interruption

  • Loss of profits

  • System failure or device malfunction

  • Issues caused by third-party software

  • Hardware defects or outdated hardware

  • Improper user installation or configuration

If liability is imposed despite these limitations, it is strictly capped at:

The amount you paid for the Services within the previous six (6) months.

Some jurisdictions may not allow certain exclusions; in such cases, limitations apply to the maximum permissible extent.

Nothing in these Terms excludes or limits any rights that cannot be excluded under mandatory consumer protection laws applicable in the user’s country

 

7. Third-Party Links & Integrations

The Services may include integrations with or links to third-party tools such as:

  • Google Analytics

  • Facebook Pixel

  • Payment gateways

  • Remote support tools

RestoreX360 is not responsible for third-party:

  • Content

  • Data handling policies

  • Security practices

  • Accuracy, reliability, or performance

Use of third-party services is at your own risk.

 

8. Prohibited Conduct

Users must not:

  • Misrepresent geographic location

  • Attempt to bypass activation or security measures

  • Use the software for harmful or malicious activity

  • Distribute unauthorized copies or malware

  • Interfere with system or network functionality

Violations may result in:

  • License termination

  • Permanent denial of support

  • Legal action

 

9. Product Updates & Modifications

The Company may, at its discretion:

  • Add, remove, or modify features

  • Release updates or patches

  • Change hardware or system requirements

  • Discontinue any part of the Services

Users are not guaranteed continued compatibility of older versions.

 

10. Refunds & Purchases

Refunds, cancellations, and returns are governed by the Global Refund Policy (separate document).

Purchases made from unauthorized dealers, resellers, or online stores:

  • Receive no warranty

  • Receive no technical support

  • May be considered invalid licenses

 

11. Technical Support

Technical support is provided exclusively under the Global Technical Support Policy.

Support may be denied if:

  • The license is invalid or unauthorized

  • Hardware does not meet the required specifications

  • Third-party software interferes with operation

  • The device contains unsupported configurations

  • The issue arises from improper installation or faulty hardware

 

12. Data & Privacy

Global data collection and processing are governed solely by the Global Privacy Policy.

  • No data is stored on RestoreX360 servers unless voluntarily provided by the user.

  • Third-party analytics tools may independently collect anonymous usage data.

 

13. Not Subject to Indian Law

These Global Terms are not governed by Indian law and are not subject to:

  • Indian IT Act

  • Consumer Protection Act

  • Indian Contract Act

  • Any India-specific regulations

Indian users must not use these Global Terms. Users are responsible for ensuring that the use of the Services complies with all local laws applicable in their jurisdiction.

 

14. Governing Law & Jurisdiction (Global Users Only)

For all users located outside India:

These Terms are governed by the laws of Gujarat, India, excluding Indian consumer protection laws.

All disputes shall be resolved exclusively in the courts of:

Rajkot, Gujarat, India

Indian users are excluded from this jurisdiction clause.

 

15. Misrepresentation of Location

If you falsely claim to be a global user while accessing Services from India, the Company may:

  • Terminate your license

  • Deny technical support

  • Void all warranties

  • Refuse refunds

  • Restrict or block future access

  • The Company reserves the right to permanently blacklist any user who intentionally misrepresents their geographic location.

 

16. No Professional Advice

All guidance, recommendations, and information provided by RestoreX360 are general in nature and do not constitute professional IT, cybersecurity, or data recovery advice.

 

17. Force Majeure

The Company is not liable for delays or failures caused by circumstances beyond reasonable control, including:

  • Natural disasters

  • War, terrorism, civil unrest

  • Internet or power outages

  • Government actions

  • Labor disruptions

 

18. No Guarantee of Data Recovery

RestoreX360 does not guarantee recovery of:

  • Files

  • Settings

  • System configurations

Recovery success depends entirely on hardware condition, system state, and user configuration.

 

19. No Agency or Partnership
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between the user and the Company.

 

20. Entire Agreement
These Terms, together with the Global EULA, Global Privacy Policy, and Global Technical Support Policy, constitute the entire agreement between the user and the Company and supersede all prior communications or representations.

 

21. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

 

22. Export Control Compliance

Users agree not to use, export, or distribute RestoreX360 software in violation of international export laws, including restrictions imposed by:

  • The United States

  • The European Union

  • The United Nations

 

23. Changes to These Terms

The Company may revise these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.

 

24. Language of the Agreement

These Terms may be translated into other languages for convenience. In case of any discrepancy, the English version shall prevail and be legally binding.

 

25. No Waiver

Failure by the Company to enforce any provision shall not constitute a waiver of that provision or any other rights.

 

26. Indemnification
The User agrees to indemnify, defend, and hold harmless the Company, its directors, employees, and affiliates from any claims, damages, losses, liabilities, or expenses arising from:
     • misuse of the Services
     • violation of these Terms
     • violation of laws applicable in the user’s jurisdiction
     • infringement of third-party rights

 

27. Survival
Sections related to intellectual property, limitation of liability, disclaimer of warranties, governing law, and jurisdiction shall survive termination of these Terms.

 

28. Termination
The Company may suspend or terminate access to the Services immediately, without prior notice, if:
• the User violates these Terms
• the User misuses the Services
• the User provides false or misleading information
• required by law or government order

Users must stop using the Services upon termination.

 

29. Assignment
The Company may assign or transfer its rights and obligations under these Terms to any affiliate or successor entity. Users may not assign their rights without prior written consent from the Company.
